Parties to this Agreement
This Online Services Agreement is a legally binding agreement between you (a single "User") and Cirta Web Systems LLC, the owner of the Service being used. This Agreement stipulates the conditions and limitations under which a User is permitted to use the Service. This Agreement stipulates that the User is an individual and not a corporation and not any other legal business entity. Cirta Web Systems LLC is a limited liability corporation. BY USING THIS ONLINE SERVICE, YOU AGREE TO THE TERMS OF THIS ONLINE SERVICES AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT CONTINUE TO USE THE SERVICE.
Service Access and License
Under this agreement, one (1) individual user is granted a right to use this Service. Collaboration is only allowed where each participant is covered by their own separate and individual account. Personal and business use of this platform is allowed under this Agreement.
No Security Guarantees
THERE IS NO DATA SECURITY GUARANTEE UNDER THIS AGREEMENT, NONE OF ANY KIND WHATSOEVER. THE USER MUST NOT RELY ON OUR TECH STACK TO KEEP ANY PERSONAL DATA SECURE AND CONFIDENTIAL. THE USER ACKNOWLEDGES THAT THIS IS NOT A SECURE STORAGE PLATFORM, AND RELIANCE ON THIS PLATFORM FOR STORAGE IS SUBJECT TO A REAL RISK OF DATA LOSS, AND ITS USE IS SUITED PRIMARILY FOR NON-CONFIDENTIAL, NON-SENSITIVE DATA.
Users are allowed to encrypt data themselves and store it on our systems, but when doing so, the risks and any resulting harm that might result is relegated under this Agreement to be the sole responsibility of that User.
Mechanisms used for privacy and data security shall consist of:
- the back-end server operating system permissions and its built in User & Group settings.
- securety features already built into the browser or user agent, requiring no additional enablement
- security layers that come with mobile devices and other edge devices requiring no additional enablement
Availability
The Service may experience outages from time to time due to maintenance and development updates.
There may also be the chance that outages and downtimes are experienced as the result of malicious attacks such as DDOS and other exploits that are outside of our control.
Data Ownership
Data ownership and intellectual property rights are not altered by this Agreeement. Use of the platform does not transfer or alter data ownership or IP rights or ownership. When Users make data public, this is done at their own discretion and any infringement of property rights that results from a User's election to make data public is not the responsibility of platform owners, administrators, or software engineers.
Pricing and Payment
Subscription prices can change at any time, either in the form of an increase or a decrease. When the subscription price drops (is decreased), no refunds will be awarded.
Prices will be honored for any months that have already been paid for.
Service Levels and Support
Technical support is provided in the form of videos and online documentation
Term and Termination
This Agreement shall be effective until it is terminated or superceded by a new Agreement. A User can terminate the agreement at any time by discontinuing to use the platform. Platform administrators can terminate the agreement at any time, and Users can choose to accept or decline to accept the new agreement.
Users will be notified about any changes to this Online Services Agreement prior to the date on which they take affect. If a User declines to accept the updated terms, the Service administrators will disallow use of the Service for that User, and remit within a reasonable amount of time, a prorated refund based on the number of days that were already paid for but experienced a denial of access.
Notice of termination can take place at the time of termination and need not be given in advance.
Our Content Policy
Under this Agreement, Users must not create content that may in any way cause harm to people or to the planet. False information, for example, brings harm to society. Documenting false information but failing to signal to content consumers that it is false, harms society.
This policy applies without regard to visibility or sharing. Things that are deemed not to be in the interest of humans and the planet will be removed and violators may lose their right to use the Service.
It is against the terms of this areement to post content that will violate the intellectual property rights of others.
No Promise of Content Moderation
The platform does not obligate itself under this agreement to monitor or moderate content beyond what is required by law. Any actions taken against policy violators will be at the sole discretion of the Service administrators.
Intellectual Property
All trademarks and platform interface elements such as images, icons, buttons and the like, are exclusively owned by Cirta Web Systems, LLC.
